Terms & Conditions of Sale

These Terms & Conditions of Sale apply to products purchased from Inspired Design (Yorkshire) Limited, trading as ID Appliances.

They apply to purchases made:

  • through our website;

  • by telephone;

  • by email;

  • in our showroom; or

  • through another agreed sales method.

Please read these terms before placing an order.

Nothing in these terms affects your statutory rights as a consumer.

2. Products

We take reasonable care to ensure that product descriptions, specifications, photographs, dimensions and other information are accurate.

However:

  • colours and finishes may appear differently depending on your screen or lighting;

  • manufacturers may make minor changes to product specifications or appearance; and

  • dimensions and specifications may be subject to reasonable manufacturer tolerances.

Where a particular feature, measurement, finish or specification is important to you, please check with us before placing your order.

3. Prices

Most products are Price on Application (POA).

Please contact us for our current price.

Where a consumer price is displayed or quoted, it will include VAT unless clearly stated otherwise.

Delivery, installation and other additional services are only included where expressly stated.

4. Quotations

We may provide quotations by telephone, email, through our website or in person.

Unless expressly stated otherwise, quotations do not have a fixed expiry date. However, a quotation is based on the product price and our costs at the time it is provided and is not a guarantee that the price will remain unchanged indefinitely.

If our cost price or the manufacturer's or supplier's price changes before you place your order, we may issue an updated quotation.

The price becomes agreed when we accept your order.

5. Placing an order

When you place an order, you are offering to purchase the relevant products subject to these terms.

An automated website acknowledgement does not necessarily mean that we have accepted your order.

Your order is accepted when we confirm that we have accepted and are proceeding with it.

Before accepting an order, we may contact you if:

  • a product is unavailable;

  • further information is required;

  • a price has changed since a quotation was provided;

  • there is an obvious pricing or product-description error; or

  • delivery or collection arrangements need to be confirmed.

If we are unable to accept an order after taking payment, we will refund the amount paid for the affected products.

6. Payment and deposits

Most orders are payable in full when the order is placed.

For larger orders, we may agree to accept a deposit with the remaining balance payable at an agreed later date.

Where this applies, we will confirm:

  • the amount of the deposit;

  • the remaining balance; and

  • when the balance must be paid.

We may require full payment before products are dispatched, delivered or collected.

Where an order is cancelled, the treatment of any deposit will depend on the circumstances of the cancellation, the type of product, any costs already reasonably incurred and your statutory rights.

We do not currently offer consumer finance.

7. Product availability

Some products are held in stock while others are ordered from manufacturers, distributors or suppliers.

Availability can therefore change.

Any estimated availability, dispatch or delivery date is given in good faith based on the information available to us at the time.

If a product becomes unavailable or is significantly delayed, we will contact you to discuss your options.

We may offer a suitable alternative product, but you are not required to accept it.

8. Special-order and made-to-specification products

Some products may be specially sourced, manufactured, configured or ordered specifically for you.

Where a product is made to your specification or clearly personalised, your normal statutory right to cancel a distance order because you have changed your mind may not apply.

Once we have placed an order for this type of product with the manufacturer or supplier, it may not be possible to change or cancel it.

For other specially sourced products, please contact us as soon as possible if you wish to make a change or cancel. Whether this is possible will depend on the status of the order and your applicable statutory rights.

Nothing in this section affects your rights where a product is faulty, damaged, not as described or otherwise.

9. Cancelling before dispatch

For standard products, if you contact us before the goods have been dispatched, we will normally be able to cancel the order and issue a refund.

This may not apply where:

  • a product has been made to your specification or personalised;

  • we have already committed to a non-cancellable special order where you do not have a statutory cancellation right; or

  • another legal exception applies.

Your statutory cancellation rights are unaffected.

10. Delivery

Products may be delivered by:

  • our own delivery team;

  • a third-party courier or delivery company;

  • a distributor;

  • the manufacturer directly; or

  • another appropriate delivery provider.

Delivery availability and charges may vary depending on the product and delivery location and will be confirmed where applicable.

Any delivery date provided is an estimate unless we specifically agree that delivery on a particular date is essential.

Where no different delivery timeframe has been agreed with you, the applicable statutory delivery requirements will apply.

If there is an unexpected delay, we will contact you as soon as reasonably possible.

11. Access, measurements and suitability

Before ordering, you are responsible for checking that the product is suitable for your property and intended location.

This includes checking, where relevant:

  • appliance dimensions;

  • packaging dimensions;

  • doorways;

  • corridors;

  • staircases;

  • lifts;

  • entrances;

  • parking and access restrictions;

  • kitchen-unit or furniture openings;

  • ventilation requirements;

  • electrical supplies;

  • gas supplies;

  • plumbing;

  • drainage; and

  • other installation requirements.

Please remember that packaged dimensions may be larger than the dimensions of the appliance itself.

If delivery cannot be completed because suitable access has not been provided, nobody is available to receive the delivery or information supplied to us was incorrect, a reasonable failed-delivery or redelivery charge may apply.

This does not affect your rights where you specifically asked us whether a product was suitable, provided us with the relevant information and reasonably relied on advice that we gave you.

12. Checking your delivery

Please inspect your products as soon as reasonably possible after delivery or collection.

You should check:

  • that you have received the correct product;

  • the packaging for visible damage;

  • the product for visible damage where reasonably possible; and

  • that the expected items are present.

We ask that obvious delivery damage, incorrect products or missing items are reported to us within 48 hours where possible.

Photographs of the product and packaging may be requested so that we can investigate the issue with the relevant delivery company, manufacturer or supplier.

Reporting an issue quickly helps us resolve it more efficiently.

The 48-hour request does not remove or limit your statutory rights if a problem is discovered later.

Where practical, please retain the original packaging until you are satisfied that the product has arrived correctly and without damage.

13. Collection

Where agreed, products may be collected from our showroom or another collection point specified by us.

We will let you know when your order is ready for collection.

You may be asked to provide your order information and suitable identification.

Responsibility for the goods passes to you when you, or someone authorised by you, takes physical possession of them.

14. Appliance storage

We understand that appliances are often purchased before a kitchen, renovation or property is ready.

By prior agreement, we may store purchased appliances for you for up to 6 months.

Storage is subject to:

  • available storage capacity;

  • the products being available to us;

  • any agreed payment requirements; and

  • any arrangements confirmed with you.

You are responsible for contacting us and arranging delivery or collection when you are ready to receive your appliances.

If the agreed storage period expires, we may require you to arrange delivery or collection.

If goods remain with us beyond the agreed storage period, reasonable additional storage charges may apply. We will tell you before any additional charge is applied.

Please be aware that storage with us does not necessarily extend a manufacturer's warranty. Manufacturer warranty periods may begin from the purchase, invoice, delivery or registration date depending on the manufacturer's own terms.

15. Installation

Installation is not included with an appliance unless we expressly state otherwise.

Where installation is available, it will be arranged separately.

The price, scope of work and installation arrangements will be confirmed separately from your appliance purchase.

You are responsible for ensuring that appropriate services and connections are available before installation, including electricity, water, drainage, ventilation and gas where applicable.

Certain products must be installed by appropriately qualified or competent persons.

We are not responsible for faults or damage caused by incorrect installation, misuse or failure to follow manufacturer requirements where the installation was not carried out by us or someone acting on our behalf.

16. Changing your mind

If you purchase goods online, by telephone or through another qualifying distance-selling method, you have a legal right to change your mind.

For most products, you have 14 days after receiving the goods to tell us that you wish to cancel.

You must then return the goods within a further 14 days.

Unless the product is faulty, incorrect or we agree otherwise, you are responsible for the direct cost of returning unwanted goods. For large appliances which cannot normally be returned by post, a collection or return cost may apply where legally permitted.

17. Condition of unwanted returns

For unwanted returns, products must be returned in their original packaging in a re-saleable condition, including all original manufacturer packaging, cable restraints, tags, protective materials and accessories.

Removal or alteration of any manufacturer-applied packaging or presentation features, including cable restraints, may mean that the item can no longer be verified or sold as brand new and may therefore affect your refund in accordance with your statutory rights.

Your statutory rights in relation to faulty, damaged, incorrect or misdescribed products are not affected.

18. Returns outside the 14-day cancellation period

If you contact us after your statutory 14-day cancellation period has expired, we may still agree to accept an unwanted product back at our discretion.

However, a restocking charge will normally apply, usually equal to 25% of the value of the returned product.

You are responsible for the direct cost of returning unwanted goods. For large appliances which cannot normally be returned by post, a collection or return cost may apply where legally permitted.

Products must be returned in their original packaging in a re-saleable condition, including all original manufacturer packaging, cable restraints, tags, protective materials and accessories.

Removal or alteration of any manufacturer-applied packaging or presentation features, including cable restraints, may mean that the item can no longer be verified or sold as brand new so we may not accept the return.

19. Products made to your specification

Some products may be made, configured or personalised specifically for you.

Because these products are produced to your individual requirements and may not be suitable for resale to another customer, they may not qualify for a cancellation or return.

This does not affect your statutory rights if the product is faulty, damaged, incorrect or not as described.

20. Faulty, damaged or incorrect products

If your product arrives damaged, is incorrect or you believe it is faulty, please contact us as soon as possible.

Where possible, we ask that obvious delivery damage, incorrect products, faults or missing items are reported within 48 hours of delivery or collection.

We may ask you to provide:

  • photographs of the product;

  • photographs of the packaging;

  • a video showing the fault; or

  • other information that helps us understand the issue.

Reporting an issue within 48 hours helps us investigate it quickly with the manufacturer, supplier or delivery company, but this timeframe does not remove or limit your statutory rights.

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund.

In some cases we may deal with the issue directly. In others, we may arrange for, or ask you to liaise with, the manufacturer's technical or service team to help diagnose and resolve the fault.

If we supplied the wrong product, or the product was faulty or damaged when supplied, we will cover the reasonable cost of returning or collecting it where we are legally responsible for doing so.

21. Returning products

Please contact us before returning a product so that we can confirm the appropriate return arrangements.

Where you arrange the return yourself:

  • the product should be packaged securely;

  • you should take reasonable care to protect it during transit;

  • we recommend using an appropriate tracked or insured delivery service; and

  • you should keep proof that the product has been sent.

We cannot accept responsibility for products which are lost or damaged during return transit where you have independently arranged the return, except where responsibility remains with us under applicable law.

22. Proof of purchase

We may ask you to provide reasonable proof that the product was purchased from ID Appliances before processing a return, refund, repair or replacement.

This may include:

  • an order confirmation;

  • receipt;

  • invoice;

  • payment record; or

  • other reasonable evidence showing that the product was purchased from us.

Please keep your receipt or order confirmation where possible.

23. How you will receive your refunds

Refunds will normally be made to the same payment method used for the original purchase.

We will inspect returned products before completing a refund.

Where permitted, we may withhold the refund until:

  • we have received the goods back; or

  • you provide evidence that the goods have been returned,

whichever happens first.

We will process refunds within the timeframe required by law, usually within 14 days of receiving the returned goods or appropriate evidence that they have been returned.

Where handling beyond what was reasonably necessary to inspect a product has reduced its value, an appropriate deduction may be made from the refund where permitted.

24. Manufacturer warranties

Many products are supplied with a manufacturer's warranty or guarantee.

Warranty periods and conditions vary between manufacturers.

You may be required to register your appliance with the manufacturer to receive certain warranty benefits or extensions.

A manufacturer's warranty is in addition to your statutory rights and does not replace them.

25. Problems that are not product faults

We are not responsible for faults or damage caused by circumstances unrelated to an inherent problem with the product.

This may include:

  • accidental damage;

  • misuse or neglect;

  • incorrect installation;

  • unsuitable electrical, gas, water or drainage connections;

  • failure to follow manufacturer instructions;

  • unauthorised modification;

  • unsuitable cleaning products; or

  • normal wear and tear.

This does not affect your statutory rights where the product itself is faulty.

26. Pricing, stock and website errors

We make reasonable efforts to keep prices, stock information and product details accurate.

If we discover an obvious error, or that a product is unavailable, before accepting your order, we will contact you and may correct or decline the order.

If payment has already been taken for an order we cannot fulfil, the appropriate amount will be refunded.

27. Events outside our reasonable control

Sometimes an order may be affected by events outside our reasonable control.

These may include:

  • manufacturer or supplier delays;

  • transport disruption;

  • severe weather;

  • shortages;

  • strikes;

  • utility or technology failures; or

  • import or customs disruption.

Where this happens, we will take reasonable steps to minimise the effect on your order and keep you informed.

This does not affect any statutory right you may have to cancel because of a significant delay.

28. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful.

This includes liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; and

  • consumer rights which cannot legally be excluded or restricted.

We are responsible for losses which are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses which were not reasonably foreseeable or for business losses arising from a purchase made as a consumer.

29. Complaints

If something goes wrong, please contact us and give us a reasonable opportunity to investigate and resolve the issue.

30. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes to our products, services, business practices or applicable law.

The terms applying to your purchase will normally be those in force when your order is placed.

31. Governing law

These terms are governed by the laws of England and Wales.

Nothing in these terms affects any mandatory consumer protections or rights available to you under applicable law.
